Cary Ginell supplied a link to Variety's website, saying "So the record companies finally lost this battle.  Now we'll see if eBay stops terminating auctions of promotional LPs and CDs.  I doubt it."

Not so fast... keep in mind Universal Music Group can always appeal to the Supreme Court... so it ain't over yet.
